§ 90.062 TREES ON PRIVATE PROPERTY.
   The owner of private property shall be required to prune or remove entirely dead, diseased or dangerous trees or broken or decayed limbs from trees located on such private property. The property owner shall have a 90 day limitation upon notification by the City Forester during which they must remove the dead or diseased tree. Trees which have been cut down or pruned tree branches shall be removed from the owner’s property or, if not in violation of other provisions of this chapter, cut into appropriate lengths for firewood and neatly stacked and stored for that purpose. The owner of private property shall be required to prune trees which overhang any public property so that the branches of the trees shall not obstruct light from any street lamp or the view of any street intersection or traffic control signs or devices. The trees shall be pruned so that its lowest branch is at least 14 feet above the adjacent street, alley or sidewalk. The City Forester is empowered to issue orders to the owners of private property where trees are located which violate the provisions of this section. In the event that the work is not performed in accordance with such orders, then the city may take immediate steps to have such condition declared a public nuisance pursuant to the provisions of this chapter. The cost of work incurred by the city shall be assessed to the property owner in accordance with the provisions of this chapter.
