§ 90.045 PERMITS NEEDED FOR ALCOHOLIC BEVERAGES, LARGE GROUPS AND AUDIO DEVICES.
   (A)   A permit must be obtained before a person may engage in any of the following activities within a city park:
      (1)   Transporting, possessing, or consuming alcoholic beverages which are in a single container having a capacity of more than 1 gallon;
      (2)   Operating or playing any audio device;
      (3)   Gathering in large groups.
   (B)   A permit may be obtained from the City Clerk (the issuing officer). A permit application shall be made upon forms provided by the City Clerk. The forms shall provide information necessary for proper investigation before issuance of the permit.
   (C)   The permit application must be signed by the applicant. The application must be submitted no less than one business day prior to the anticipated date of the event. An applicant must be at least 18 years of age. However, if alcoholic beverages are involved, then the applicant must be at least 21 years of age.
   (D)   If the City Clerk decides that a permit application should be reviewed by the Council before a permit is issued, then the application shall be brought before the next regular Council meeting. If the City Clerk denies a permit, then the applicant shall be advised of their right to appeal the denial to the City Council. The applicant shall have 30 days from the date of the denial to request an appeal. The permit applicant shall be advised of the meeting date and time. In any case where the application for a permit is before the City Council, the applicant shall personally appear at the Council meeting. Failure to appear shall constitute grounds for denying the application for a permit.
   (E)   The permit shall specify such conditions as the issuing officer or Council deem necessary to enhance the use and enjoyment of a park by the public.
   (F)   The permit shall specify that the applicant is personally responsible for ensuring compliance with the conditions of the permit and with the provisions of this section of the Code. A copy of the permit shall be given to the applicant. The applicant or, in the absence of the applicant from the park, another responsible adult shall keep the permit in possession while the permitted activity occurs in the park. The permit shall be shown to a police officer or park employee upon request.
   (G)   A copy of the permit shall also be given to the Police Department. The Police Department shall be empowered to monitor compliance with the conditions of a permit. A police officer may revoke a permit and terminate park use of that group if there is a significant violation of the conditions of a permit or any provision of the City Code.
