§ 90.002 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALCOHOLIC BEVERAGE. Any beverage containing more than 0.5% alcohol by volume.
   AUDIO DEVICE. A loudspeaker, public address system, or sound amplifying equipment.
   FUND-RAISING ACTIVITY. Any sale of goods or services or solicitation of funds. Also, any activity where goods or services are provided as a result of a sale occurring at another time or place.
   LARGE GROUPS. A group of more than 50 people gathered together for the same purpose.
   LITTER. Garbage, refuse or rubbish and all other waste materials which, when discarded or maintained improperly, tend to create a danger to public health, safety and welfare.
   NATURAL TERRAIN. Areas other than roadways, driveways (private or public), parking lots, and similar areas.
   OCCUPANT. The person living on or the renter/tenant of real property.
   OPERATE. To drive, operate or physically control a vehicle.
   OPERATOR. Every person who drives, operates or is in physical control of a vehicle.
   OWNER. The possessor of the fee title to real estate or the person purchasing fee title by contract. Also, the person having the title to a vehicle.
   PARK. Any real estate within the city which has been dedicated to or purchased by the city and which is intended for recreational activities.
   PRIVATE PROPERTY. All real estate which is not public property.
   PUBLIC PROPERTY. Land, buildings, or fixtures owned or leased by the city, formally dedicated to the public benefit or actually used by the public without formal dedication but in a manner which creates the appearance of dedicated public property.
   PUBLIC TREES. Trees, shrubs or bushes located in parks or on other public property.
   RECREATIONAL MOTOR VEHICLE. A motor vehicle used for recreational purposes, including but not limited to trail bikes, mini bikes, amphibious vehicles, all terrain vehicles, or snowmobiles.
   TREE TOPPING. The severe cutting back of limbs larger than 3 inches in diameter within the crown of the tree to such a degree so as to remove the normal canopy and disfigure the tree.
