§ 55.03 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   RECYCLABLE MATERIALS. Materials that are separated from mixed municipal solid waste for the purpose of recycling, including paper, glass, metals, automobile oil, batteries and other specifically allowed items. Refuse derived material or other material that is destroyed by incineration is not a recyclable material.
   RECYCLING FACILITY. A recycling facility is a center for the collection, processing or repair of recyclable materials for reuse in their original form or use in manufacturing processes. Recycling facilities may include the following.
      (1)   DESIGNATED FACILITY. A recycling facility, which has complied with the permitted rules of the Pollution Control Agency and is open a minimum of 12 operating hours each week, 12 months each year and accepts for recycling at least four different materials such as paper, glass, plastic and metal.
      (2)   COLLECTION FACILITY. A collection facility is a place where the public may donate, redeem, or purchase, recyclable materials. COLLECTION FACILITIES may include vending machines, mobile units, unattended containers placed for the donation of recyclable materials and permanent structures.
      (3)   REVERSE VENDING MACHINES. A reverse vending machine is an automated mechanical device which accepts at least 1 or more types of empty beverage containers, including, but not limited to, aluminum cans, glass and plastic bottles, and issues a cash refund or a redeemable credit slip. A reverse vending machine may sort and process containers mechanically provided that the entire process is enclosed within the machine.
      (4)   MOBILE RECYCLING UNIT. A mobile recycling unit means an automobile, truck, trailer or van which is used for the collection of recyclable materials. A mobile recycling unit also means the bins, boxes or containers transported by trucks, vans, or trailers, and used for the collection of recyclable materials.
   NOXIOUS MATTER. Any solid, liquid, or gaseous material, including, but not limited to, gases, vapors, odor, dusts, mists, or combinations thereof, that in the opinion of the Council, the emission of which is/could be detrimental to or endangers the public health, safety, comfort or general welfare or causes/could cause damage to property.
