The owner and occupant of a pick-up location which did not at any time receive service in the period from 9-1-1979 through 2-29-1980 and who provides evidence to the Water Department of the existence of a private agreement for the services as herein defined, which agreement has existed continuously from 9-1-1979 through 2-29-1980, and is ongoing for such service, shall not be deemed to have service available under this subchapter and such owner and occupant shall not be subject to charges for service under this subchapter.
