Any delay, preemption, or other failure to provide cable service and to perform other duties contained in this chapter and the franchise agreement by the grantee caused by factors beyond the grantee’s control, such as acts of God, labor disputes, non-delivery by program suppliers, war, riots, government order or regulation, shall not result in a breach of the terms of this chapter and franchise agreement. Grantee shall exercise its reasonable efforts to cure any such delays and the cause thereof, and performance under the terms of this chapter and franchise agreement shall be excused by the city for the period of time during which such factors continue.
