5-12-1: DEFINITIONS:
For purposes of this chapter, the following definitions shall apply:
EMERGENCY RESPONSE: Providing, sending or utilizing, through any means, police, emergency medical services, rescue services, public works services or related services and personnel by the city or by any other municipality, corporation or individual operating at the request or direction of the city to an incident which threatens or may threaten, directly or indirectly, the public health, safety and welfare within the city. Such incidents shall include, but are specifically not limited to, accidents, fires, vehicular extrication efforts, medical rescue responses or any hazardous condition which threatens or may threaten the public health, safety and welfare within the city.
EMERGENCY RESPONSE CHARGE: Any expense for personnel and equipment involved in an emergency response. Emergency responses include, but are not limited to: police services; firefighting services; vehicle accidents involving rollover, bridge or embankments, gas, fluid or cargo spills and other hazardous materials; accident reconstruction services; emergency rescue services; emergency medical services; hazardous materials response teams; civil defense services; technical rescue teams; public works service and the services performed by a private contractor providing an emergency response at the request of the city.
RESPONSIBLE PARTY: Any person or entity owning, controlling, leasing, having custody over or conducting any activity upon any land, facility, equipment or vehicles who creates or contributes to the creation of any incident that requires an emergency response. (Ord. O-20-2015, 9-14-2015)
