3-2-12: PUBLIC RIGHT OF WAY LICENSE FEE:
   A.   Definitions: For purposes of this section the following definitions shall apply:
   FIBER OPTIC CABLE: A high speed transmission cable used to transmit digital data via rapid pulses of light.
   PERSON: Any natural individual, firm, trust, estate, partnership, association, joint stock company, joint adventure, corporation, municipal corporation or political subdivision of the state or a receiver, trustee, conservator or other representative appointed by order of any court.
   RIGHT OF WAY: Any City street, alley, water or public right-of-way dedicated or commonly used for vehicular or pedestrian traffic as well as utility purposes, including utility easements wherein the City has acquired the right and authority to locate or permit the location of utilities.
   RIGHT OF WAY shall not include any real or personal City property that is not specifically described in the foregoing sentence and shall not include City buildings or other structures or improvements, regardless of where they are situated in the right-of-way.
   B.   A license fee is hereby imposed on all persons engaged in the installation and/or maintenance of fiber optic cable in the right-of-way at the rate of ten dollars ($10.00) for each foot of fiber optic cable installed and/or maintained in the right-of-way.   
   C.   License Agreement/Payment of License Fee: No person shall install any fiber optic cable in the right-of-way until that person has executed a license agreement with the City and has paid the license fee imposed by this section.   
   D.   Exemption: The license fee imposed by this section shall not apply to any person paying the municipal utility tax pursuant to Section 3-2-4 of the Northlake City Code. (Ord. O-02-2020, 3-2-2020)
