PENDING ORDINANCES
ORDINANCE NO. O-05-2020
AN ORDINANCE VACATING AN ALLEY LYING BETWEEN WOLF ROAD AND LAVERGNE AVENUE IN THE CITY OF NORTHLAKE, COOK COUNTY, ILLINOIS
(NUMBER 1)
WHEREAS, the Mayor and City Council have determined that the vacation of the alleydescribed below will enhance the development of the property that is adjacent to the said alley; and
WHEREAS, the Mayor and City Council have determined that pursuant to 65 ILCS 5/11-91-1 and Northlake’s home rule powers, the owners of the adjacent parcels described in Section 3 hereof shall acquire title to the alley being vacated; and
WHEREAS, the Mayor and City Council have determined that the City would benefit from the vacation of the alley by reducing City expenditures on maintenance, repair and replacement of the alley (the “Maintenance Relief Benefit”) and the vacation of the alley and the devolution of title to the alley to the owners of the property lying east and west of the alley is in the public interest; and
WHEREAS, in the judgment of the Mayor and City Council, the value of the Maintenance Relief Benefit constitutes compensation that equals or exceeds the benefits which will accrue to the owners of the property lying east and west of the alley by reason of the vacation. 
NOW, THEREFORE, be it ordained by the Mayor and City Council of the City ofNorthlake, Cook County, Illinois in the exercise of Northlake's home rule powers as follows:
SECTION 1: The foregoing preambles are restated and incorporated herein byreference though fully set forth herein.
SECTION 2: The alley as shown on the Plat of Vacation attached hereto as Exhibit Aand legally described as follows:
THAT PART OF NORTH-SOUTH PUBLIC ALLEY IN BLOCK 15 IN THE H. O. STONE NORTHLAKE ADDITION BEING A SUVDIVISION OF THAT PART OF THE NORTHEAST QUARTER OF SECTION 6, TOWNSHIP 39 NORTH, RANGE 12, EAST OF THE THIRD PRINCIPAL MERIDIAN AND DESCRIBED AS FOLLOWS:  BEGINNING AT THE SOUTHWEST CORNER OF LOT 11 IN THE H. O. STONE NORTHLAKE ADDITION, THENCE NORTH 75° 38’ 28” WEST 20.63 FEET TO THE SOUTHEAST CORNER OF LOT 22 IN THE H. O. STONE NORTHLAKE ADDITION, THENCE NORTH 00° 11’41” EAST ALONG THE EAST LINE OF LOTS 22 THROUGH 24 IN THE H. O. STONE NORTHLAKE ADDITION 145.52 FEET TO THE NORTHEAST CORNER OF SAID LOT 24; THENCE NORTH 88° 13’ 32” EAST ALONG THE NORTH LINE OF SAID LOT 24 EXTENDED EASTERLY 20.01 FEET, TO THE WESTERLY LINE OF LOTS 5 THRUGH 11 IN THE H. O. STONE NORTHLAKE ADDITION, THENCE SOUTH 00° 11”41” WEST ALONG SAID WESTERLY LINE 151.25 FEET TO THE POINT OF BEGINNING, IN COOK COUNTY, ILLINOIS.
is hereby vacated subject to an easement for the benefit of the City of Northlake, Commonwealth Edison Company, Nicor Gas Company, AT&T and any other service or public utility, including any franchised cable television company, their successors and assigns for the maintenance, renewal and reconstruction of public and private utilities together with right of ingress and egress at all times.
   SECTION 3:   Upon vacation of the above described alley, title to the east one-half of the alley herein vacated shall vest in the record owners of the land abutting the east one-half of the vacated alley to the extent of the common borders of their respective parcels with the said alley and title to the west one-half of the alley herein vacated shall vest in the record owners of the land abutting the west side of the vacated alley to the extent of the common borders of their respective parcels with said alley. 
   The permanent index numbers of the land abutting the west one-half of the alley described above are as follows:

   SECTION 4: If any section, paragraph, clause or provision of this ordinance shall beheld invalid, the invalidity thereof shall not affect any of the other provisions of this ordinance.
SECTION 5: All ordinances in conflict herewith are hereby repealed to the extent ofsuch conflict.
SECTION 6: This ordinance shall be in full force and effect from and after its passage,approval and publication as provided by law.
