(a) Definition. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(1) “Weeds, vines, grasses and other vegetative growth” means ragweed, grasses, daisies, goldenrod, burdock yellow dock, dandelions, thistle, wild carrot and any other injurious offensive or annoying pollen, dust, down, seed or particles, or any other vegetative growth which may emit said particles or conceal any filthy, noxious or prohibited deposits of any material whatsoever.
(b) (1) All owners or occupants of real property improved with a septic system or with structures thereon and located within the limits of the Village shall periodically cut and properly dispose of all weeds, vines, grasses or other vegetative growth growing upon such real property so as to insure no weeds, vines, grasses or other vegetative growth exceeds six (6) inches in height. This section shall not apply to cultivated plants or growing crops.

(2) Any person owning or occupying real property improved with a septic system or with structures thereon and located within the limits of the Village which has growing in, on or upon such real property weeds, vines, grasses or other vegetative growth described in subsection (a) hereof, which exceeds a height of six (6) inches shall be in violation of this section.

(c) All owners or occupants of real property improved with a septic system or with structures thereon and located within the limits of the Village shall, effective May 1 of each calendar year, insure all weeds, vines, grasses or other vegetative growth as defined in subsection (a) hereof, are properly cut and disposed of with such frequency so as to insure compliance with subsection (b) hereof. Compliance with subsection (b) hereof is required from May 1 through November 1 of each calendar year.
(d) If any owners or occupants of real property improved with a septic system or with structures thereon and located within the limits of the Village fail to cut all weeds, vines, grasses or other vegetative growth described in subsection (a) hereof between May 1 and November 1 of each calendar year, the Mayor may cause such weeds, vines, grasses or other vegetative growth to be cut. Thereafter, the owner of the real property upon which the weeds, vines, grasses or other vegetative growth was cut shall be indebted to the Village for the actual expense incurred by the Village in cutting the weeds, vines, grasses or other vegetative growth.

(e) In the event the owner or occupant of real property improved with a septic system or with structures thereon and located within the limits of the Village fails to reimburse the Village for the actual cost of cutting and disposing under subsection (d) hereof, the Clerk-Treasurer shall certify such costs along with a clerical services fee of fifty dollars ($50.00) to the Ashtabula County Auditor with a request that said amount should be assessed against the subject real property and entered upon the real property’s tax duplicate for collection by the County Auditor. The amount so entered shall be a lien upon the subject real property and any premises located thereon from the date the same was entered; shall be collected as other real property taxes; and, shall, upon collection by Ashtabula County, be returned to the Village of North Kingsville for deposit into the Village General Fund.
