The Town Building Department shall have all rights, powers, privileges, and authorities as are provided under the Indiana Unsafe Building Law as the department authorized to administer and enforce the Indiana Unsafe Building Law. It is hereby acknowledged, understood, and declared by the Town Council that the Town Building Inspector is required to exercise and is vested with the authority to exercise his or her discretion and judgment in order to protect and preserve the public health, safety, and general welfare of the citizens of the town in administering and enforcing this subchapter. The authority of the Town Building Commissioner to issue, deny, suspend, or revoke, or fail or refuse to issue, deny, suspend, or revoke any permit, license, approval, order, or similar authorization under this subchapter is hereby declared to be discretionary.
