(a) Hours and Age Limits For Minors. No child under the age of fourteen years shall be upon the streets and sidewalks between the hours of 11:00 p.m. and 5:00 a.m. of the following morning, nor shall any child between the age of fourteen and eighteen years be upon the streets or sidewalks between the hours of 12:00 midnight and 5:00 a.m. of the following morning. However, the provisions of this section do not apply to:
(1) A minor accompanied by his parent, guardian or other adult person having the care and custody of the minor; or
(2) A minor during his or her hours of employment and travel to and from the place of employment; or
(3) A minor who is returning home from or traveling to a school function.
(b) Parents and Guardians to Comply. No parent or guardian of any child under the age of fourteen years shall allow such child on the streets or sidewalks between the hours of 11:00 p.m. and 5:00 a.m. of the following morning, nor shall any parent or guardian of any child between the age of fourteen and eighteen years allow such child to be upon the streets or sidewalks between the hours of 12:00 midnight and 5:00 a.m. of the following morning. However, the provisions of this section do not apply to a minor accompanied by his parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his parent, guardian or other adult person having the care and custody of the minor.
(c) Any minor violating this section shall be dealt with in accordance with Juvenile Court Law and procedure. Whoever violates subsection (b) hereof is guilty of a minor misdemeanor. (Ord. 5-1995. Passed 4-17-95.)
