(a) The operator of a vehicle about to enter or cross a street from a private road, driveway, alley or building, in addition to stopping and yielding the right of way to all traffic approaching on the street, shall not enter an area of the street controlled by a traffic control signal between the traffic control signal’s crosswalks until the traffic control signal shows a green or yellow signal to such operator facing the traffic control signal.

(b) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
