(a) Nonconforming Uses. A Certificate of Occupancy shall be required for each nonconforming use existing at the time of passage of this Zoning Ordinance or which may be created through any amendment thereto. Application for such Certificate of Occupancy for a nonconforming use shall be filed with the Building Commissioner by the owner or lessee of the building or premises occupied by such nonconforming use within one year from the date such use becomes nonconforming. It shall be the duty of the Building Commissioner to issue a Certificate of Occupancy for the nonconforming use upon such application, but failure to obtain such Certificate of Occupancy within one year from the date shall create a conclusive presumption that such nonconforming use did not exist prior to the effective date of this Zoning Ordinance or of an amendment thereto, as the case may be.
