ORDINANCE NO. 2020-03
AN ORDINANCE ESTABLISHING THE POSITION OF BUDGET OFFICER
WHEREAS, the President and Board of Trustees have determined that it is in the best interests of the Village to provide for the position of Budget Officer and that the Village Administrator shall serve concurrently as the Budget Officer pursuant to appointment as provided for herein.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of North Barrington, Lake County, Illinois, as follows:
SECTION 1: That the following subsections of the Village Code of the Village of North Barrington at Title 1, Chapter 7, Section 1-7-50, is hereby amended and shall hereafter state as follows: (single underlines, denote inserted language and strikethroughs, denote deleted language)
1-7-50 AUTHORIZATION TO EMPLOY VILLAGE ADMINISTRATOR; APPOINTMENT.  The Village President and Board of Trustees are hereby authorized to employ a Village Administrator. Such Administrator shall be appointed by the Village President, by and with the advice and consent of the Board of Trustees.  The Village Administrator shall also serve as the Budget Officer for the Village, subject to appointment by the Village President and with the advice and consent of the Board of Trustees.
SECTION 2. If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 4: This Ordinance shall be in full force and effect upon its passage, approval and publication in pamphlet form (which publication is hereby authorized) as provided by law.

An Ordinance Amending Title 2, Chapter 5 Environmental and
Health Commission of the North Barrington Municipal Code
 
WHEREAS, the Village of North Barrington (the “Village”) is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and,
 
WHEREAS, the Village President and Board of Trustees have determined that it is appropriate to amend Title 2, Chapter 5 of the North Barrington Municipal Code regarding the Environmental and Health Commission.
 
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of North Barrington, Lake County, Illinois, as follows:
 
SECTION 1: Title 2, Chapter 5 Environmental and Health Commission, of the North Barrington Municipal Code is hereby amended and shall hereafter state as follows (single underlines, denote inserted language and strikethroughs, denote deleted language):

1-4-1   : ESTABLISHED; MEMBERS:
 
 
 
A.   Establishment: There is hereby created an Environmental and Health Commission, which is an advisory body to the Board of Trustees, except as to matters where the Village Code gives final authority to the Commission.an administrative agency of the Village as hereinprovided. When used in this Chapter, “Commission” shall be construed to mean the Environmental and Health Commission and “Commissioners” shall be construed to mean the members of the Commission.
 
B.   Members: The commission shall consist of six (6) members plus the Chair, all of whom shall be appointed by the Village President with the consent of the Board of Trustees; provided, however, that effective May 5, 2007 (being the effective date hereof), the commission shall consist of the Chairperson and eight (8) other persons and as vacancies occur on the commission by reason of death or resignation from office or the failure of the President and Corporate Authorities to reappoint an existing commission member, the number of commission members shall be reduced until there are a Chair and six (6) other members. (Ord. 1114, 4-25-2007)The Commission shall consist of five Commissioners appointed by the Village President with the advice and consent of the Village Board. The Village President shall designate
B.   one of the Commissioners to serve as Chairperson. The position of the Chairperson shall be reviewed on an annualbasis.
 
C.   Term OofOffice: Eachappointedmemberofthecommissionshallserveforatermofone year, reviewed and subject to reappointment annually, or until a successor is appointed. (Ord. 1330,7-25-2018)The first appointees shall serve for the following terms, or until their respective successors, in similar manner, have been appointed and qualified: two for one year, two for two years, one for three years. Successors to each member so appointed shall serve three-year terms, except that vacancies shall be filled for the unexpired term of the seat vacated. The term of each Commissioner shall expire April 30 of the year of expiration of its respective term ofoffice.
 
D.   Resignations; Vacancies: The Village President and Board of Trustees may accept the resignation of any member of the commission and the seat shall be considered vacant. A vacancy also occurs upon death, removal from the Village, or by removal from office for cause pursuant to section1-7-10of this Code. Vacancies occurring shall be filled by appointment by the Village President and concurrence by the Board ofTrustees.
E.   Compensation: Commissioners shall serve their appointed terms without compensation.The members of the commission shall receive such compensation, if any, as may be fixed by the Board of Trustees. (Ord. 1114, 4-25-2007)
 
 
 
1-4-1   : MEETINGS:
 
The Environmental and Health Commission shall meet monthly, on the first Tuesday of each month.  Special meetings of the Commission may be calledor at the call of by the Chairperson or by any two (2) members of the commissionCommission. All meetings are open to the public, and given proper notice per State Statutes and Village ordinances. (Ord. 1114, 4-25-2007)
 
 
 
A.   The Commission shall hold public meetings, and where appropriate, public hearings, on issues related to Title 4 – Public Health and Sanitation and Title 5 – Environmental Concerns of the Village Code or at the direction of the Village President and Board of Trustees.
 
The presence of a majority of the Commission members then in office shall be necessary to constitute a quorum to transact any Commission business at any regular or special meeting of the Commission.
 
 
 
1-4-1   : POWERS AND DUTIES:
 
 
 
A.   To collect general environmental and/or technical information as may pertain to the quality of life within the Village and to make such material available to the Village President and Board of Trustees.
B.   To alert the Village President and Board of Trustees to state and federal laws relative to the environment which may require attention and/or action on the part of the board.
 
 
 
A.   To make recommendations to the Village President and Board of Trustees for adoption of policies, programs and/or goals which would improve or sustain the environment of the Village and which would not conflict with state or federal laws.
 
 
A.   The Environmental and Health Commission shall hold public meetings, and where appropriate, public hearings, on environmental, health and sanitation and public health matters pursuant to Village Code provisions or at the direction of the Village President or the Corporate Authorities. Environmental matters shall include, but are not limited to, stormwater management and mosquito abatement; health and sanitation and public health matters shall include, but are not limited to, individual sewage treatment systems (septic systems), and other sanitation matters. Except as to matters where the Village Code gives final authority to thecommission,thecommissionisanadvisorybodytotheBoardofTrustees.
 
 
 
A.   The Environmental and Health Commission may consider an application for a septic variance for a specific property, but only upon proof of notification by the applicant to all real estate taxpayers within two hundred fifty feet (250') from the specific location of the proposed variation. Said notice shall advise such taxpayers of the variance requested and the time and date of the meeting of the Environmental and Health Commission.  Notice shall be given not less than ten (10) nor more than thirty-five (35) days prior to the meeting of the commission where the request shall be considered. A.   To perform such other duties and functions as may be requested by the Village Board of Trustees.
 
 
 
 
1-4-1   : REPORTS AND RECORDS
 
 
 
A.   The Commission shall submit recommendations to the Village Board in writing.  A minority report may be attached to the majority recommendation.
 
B.   The Recording Secretary shall have the followingduties:
 
 
 
1.   Record and maintain permanent minutes of the Commission meetings and hearings.Minutes shall show the vote of eachCommissioner upon every question, or if absent or failing to vote, indicating that fact.
 
2.   All official records of the Commission shall be maintained by the Clerk. Before official records are turned over to the Clerk, the Recording Secretary shall be the custodian of the records and any exhibits submitted.
 
 
SECTION 2.
