9-2-3: FINAL PLAT; APPROVAL:
   A.   Requests For Approval Of Final Plat: Requests for approval of the final plat shall be submitted in writing to the Plan Commission at least forty five (45) days prior to the meeting at which it is to be considered and shall be submitted within six (6) months after approval of the preliminary plat unless such time is extended by the corporate authorities.    B.   Conformance With Preliminary Plat: The final plat shall conform substantially to the preliminary plat as approved, and if desired by the subdivider, it may constitute only that portion of the approved preliminary plat which he proposes to record and develop at the time; provided, however, that such portion conforms to all requirements of these regulations.
   C.   Distribution Of Copies; Time Limit: Four (4) copies of the final plat, plans and other exhibits required for approval shall be prepared as specified in chapter 5 of this title, and shall be submitted to the Plan Commission for review by the Village Engineer within one year after approval of the preliminary plat; otherwise, such approval shall become null and void unless application for an extension of time is made to and granted by the Plan Commission.
   D.   Approval Or Disapproval By Plan Commission: Within forty five (45) days after application for approval, the Plan Commission shall approve or disapprove the final plat; provided, that the subdivider has supplied all documents and materials required by ordinance or law. If the Plan Commission approves, it shall be certified by the signature of its chair. If the Plan Commission disapproves, it shall set forth its reasons in its own records, and provide the applicant and the corporate authorities with copies.
   E.   Approval Required By Corporate Authorities; Notice: The corporate authorities shall approve or disapprove the proposed final plat within sixty (60) days after the decision of the Plan Commission. By mutual agreement, the subdivider and corporate authorities may agree to extend the sixty (60) day period. (1977 Code § 11-3-3; amd. 2004 Code)
   F.   Recordation Of Plat: The subdivider shall post a performance guarantee with the Village as set forth in section 9-3-2 of this title and the final plat shall be recorded in the office of the Lake County Recorder by the Village or its designee within one year after the date of its approval. The corporate authorities may extend such time for posting the performance guarantee and of recording in its discretion upon application. (Ord. 1092, 6-28-2006)
