9-2-2: PRELIMINARY PLAT; CONDITIONAL APPROVAL:
   A.   Preparation Of Preliminary Plat And Other Materials: On reaching conclusions, informally, as recommended in section 9-2-1 of this chapter regarding his general program and objectives, the subdivider shall cause to be prepared a preliminary plat, together with improvement plans and other supplementary material as specified in chapter 5 of this title.
   B.   Submission To Village: Twelve (12) copies of the preliminary plat and supplementary material specified shall be submitted to the Village with written application for conditional approval at least thirty (30) days prior to the initial Plan Commission meeting at which it is to be considered.
   C.   Deposit Required: Along with the application for conditional approval of the preliminary plat, the subdivider must deposit in the "trust and agency (T&A) account" with the Village such amount as determined by the Village President 1 . This account is to be used to provide reimbursement to the Village for Village expenditures for all staff and outside consultants' time to review and approve plans, specifications and other documents and for construction supervision of the approved subdivision improvements. This account must be maintained until subdivision improvements have been approved. Upon approval of the improvements, any account funds not used will be returned to the subdivider.    D.   Approval Or Disapproval: Following review of the preliminary plat and other data submitted in compliance with these regulations, and following discussions with the subdivider on changes deemed advisable and the kind and extent of improvements to be made by the subdivider, the Plan Commission shall, within ninety (90) days from the date of the application or the filing by the subdivider of the last item of required supporting data, act on the plat and data as submitted or modified, and if approved, the Plan Commission shall express its approval as "conditional approval" and state the conditions of such approval, if any; if disapproved, the Plan Commission shall express its disapproval in writing and its reasons therefor. The Plan Commission's action shall be forwarded to the corporate authorities for final action.
   E.   Approval Required By Corporate Authorities; Notice: The corporate authorities shall approve or disapprove the proposed preliminary plat within sixty (60) days after the decision of the Plan Commission. By mutual agreement, the subdivider and corporate authorities may agree to extend the sixty (60) day period.
   F.   Distribution Of Copies: The actions of the Plan Commission and corporate authorities shall be noted on three (3) copies of the preliminary plat, referenced and attached to any conditions determined. One copy shall be returned to the subdivider, one retained by the Plan Commission, and one retained by the Village Clerk. (Ord. 1092, 6-28-2006)
   G.   Approval Of Preliminary Plat Not Approval Of Final Plat: Conditional approval of a preliminary plat shall not constitute approval of the final plat. Rather it shall be deemed an expression of approval to the layout submitted on the preliminary plat as a guide to the preparation of the final plat which will be submitted for approval by the Plan Commission not later than one year after preliminary approval has been granted.
   H.   Areas Subjected To Flooding; Surface Water Drainage: No plat will be approved for a subdivision which does not comply with the requirements of title 5, chapter 5 of this code. (1977 Code § 11-3-2; amd. 2004 Code)
