9-1-11: VARIATIONS:
The Village Board may waive or vary the strict requirements of any of the provisions of this title, including the requirement of a plat of subdivision if such waiver of plat requirement is consistent with state statutes, when the Village Board finds that there are unusual or extraordinary conditions or hardships relative to the property or that the enforcement of the regulations in a specific case is not required in the public interest. In addition, where the Plan Commission finds that extraordinary hardships may result from strict application of the requirements of the regulations of this title to any proposed plat of subdivision or otherwise finds that there are unusual conditions or hardships relative to particular property and its development, the Plan Commission may recommend to the Village Board that one or more requirements of this title be waived as to said plat of subdivision. No variation of this title shall be granted except by motion or resolution adopted by the Village Board or by acceptance of such plat by the Village Board. (1977 Code § 11-1-9)
