A. Setback Requirements: Ponds and artificial lakes shall be classified as accessory structures and shall conform to setbacks as required for such structures in this title and the zoning ordinance of the Village. (1977 Code § 4-6-4; amd. 2004 Code)
B. Location Near Septic Systems: The shoreline at highest flood level shall not be closer than fifty feet (50') from any portion of a septic field.
C. Lot Size:
1. Total area of the tract of land containing the pond must be not less than twice the area of the pond at its highest flood level.
2. Where a dwelling is in existence on the tract which is to contain a pond or artificial lake, the tract must contain not less than forty thousand (40,000) square feet, and no dwelling shall be erected on a tract containing a pond or artificial lake which is hereinafter constructed, unless the tract contains not less than forty thousand (40,000) square feet.
