559.07 RECREATIONAL ACTIVITIES.
   (a)   No person or persons on Reservoir Property and adjacent Village-owned land, any Village operated park or other recreational facility shall:
      (1)   Bathing and swimming prohibited. Bathe, swim, wade, wash, urinate or deposit fecal matter in Reservoir waters or waters flowing into said Reservoir. Nor shall any person or persons urinate or deposit fecal matter anywhere on Reservoir property or other Village-operated property adjacent thereto.
      (2)   Boating.
         A.   Seasonal requirements. Leave a private dock or boat upon Reservoir property. Failure to remove the dock or boat will result in their impoundment and the same shall be considered abandoned by the owner.
         B.   Boat requirements. Operate any boat other than sailcraft, canoes, rowboats and non-powered, fishing boats. The use of any other type of boat shall be unlawful.
         C.   Power, reservoir. Operate any boat other than those powered by sail, paddle or oars.
         D.   Seaworthiness. Operate any unseaworthy boat or any boat which fails to meet U.S. Coast Guard Standards for the conditions. All boats will be subject to inspection by the Police and shall be removed from the water should they find them unsafe under said standards. The Chief of Police shall determine the seaworthiness of watercraft based on water design, capacity, condition of facilities, weather conditions and compliance with safety regulations. He may deny entry of any boat to Reservoir waters if he finds it unfit, and his decision is final.
         E.   Unauthorized use of mooring and buoys. Use mooring and marker buoys unless authorized to do so.
         F.   Unauthorized use of power. Use a motor on a craft not specifically designed to be motor propelled or specifically adapted to the use of a motor.
         G.   Capacity of boats. Operate any boat which exceeds the recommendations of the manufacturer or designer as to maximum capacity for the boat, or to so overload a boat so as to make it unsafe.
         H.   Sanitary requirements. Operate, launch, dock, moor or use any watercraft which contains a sink, toilet or sanitary system which is capable of discharging urine, fecal matter, contents of a chemical commode, kitchen wastes, laundry soaps, any waste material whatsoever into the water of said Reservoir. No person shall dispose of any of these or other waste material by any means into said water, whether deemed contaminative or not. Any such facility aboard shall be sealed off or removed.
         I.   Designated areas. Bring into or operate any boat, raft, or other watercraft, upon any waters, except at places designated for boating by Council. Such activity shall be in accordance with applicable regulations as are now or may hereafter be adopted.
         J.   Operation of boats. Navigate, direct, or handle any boat in such manner as to unjustifiably or unnecessarily annoy or frighten or endanger the occupants of any other boat.
         K.   Prohibition during closing hours. Launch, dock, or operate any boat of any kind on any waters between the closing hours of the Reservoir at night and opening hour the following morning. Such hours are to be determined by Council.
   (b)   Any person violating any provision of the within section shall be deemed guilty of a minor misdemeanor.
