935.13 OWNER’S RESPONSIBILITY TO SEVER CONNECTIONS.
   Person(s) owning or having control of property in the Village shall be required to sever all sources of storm or surface run off water currently flowing through any lateral that carries sewage to the Village sanitary sewer system. If a separate storm sewer is made available by the Village, the person(s) owning or having control of said property shall be responsible, at their cost, for installing separate lateral storm sewer connections to divert storm water, surface water, roof and footer drainage from their property, to the separate Village storm sewer lines. Available shall mean that said public storm sewer line is located in the public right-of-way adjacent to said property, or immediately across the street or alley right-of-way from said property. Owner’s cost shall include the expense of running the lateral to the property line nearest the point where the Village has made a tap available to connect to a sewer. The Village shall bear the expense of making the necessary connection with the available sewer, if the combined sanitary/storm sewer connection pre-existed September 1, 2008. If a combined connection did not exist prior to September 1, 2008, it shall be the property owner’s responsibility to pay the cost of the connection or tap. The tap or connection fee shall be published in the Water/Sewer Fee and Penalty Schedule approved by Council. Said schedule is subject to change. (Ord. 08-25. Passed 7-1-08.)
