915.99 PENALTY.
   (a)   Any Discharger who is found to have violated an Order of the Village Administrator or his authorized representative or who has failed to comply with any provision of this chapter, or orders of any court of competent jurisdiction may be guilty of a minor misdemeanor and upon conviction thereof shall be fined in an amount not exceeding one thousand dollars ($1,000) for each violation. Each day in which any such violation shall continue shall be deemed a separate offense.
   (b)   Any Discharger violating any of the provisions of this chapter, or who discharges or causes damage to or impairs the Village wastewater disposal system shall be liable to the Village for any expense, loss or damage caused by such violation or discharge. The Village Administrator or his authorized representative shall bill the Discharger for the costs incurred by the Village for any cleaning, repair or replacement work caused by the violation or discharge. Refusal to pay the assessed costs shall constitute a violation of this chapter enforceable under the provisions of Section 915.09.
   (c)   Any person who knowingly makes any false statement, representation or certification in any application, record, report, plan or other document filed or required to be maintained pursuant to this chapter, or who falsifies, tampers with, or knowingly renders inaccurate any monitoring device or method under this chapter, shall upon conviction, be punished by the imposition of a penalty of not more that one thousand dollars ($1000) on a first offense. A second offense, and any subsequent offense within two years, shall constitute a first-degree misdemeanor. (Ord. 11-06. Passed 5-3-11.)
