915.05 BUILDING SEWERS AND CONNECTIONS; PERMITS AND LICENSES.
   (a)   Permit Required. No person shall uncover, make any connections with or opening into, use, alter, or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Village of North Baltimore. Provided, however, a new permit will not be issued when it has been determined by the Village that there does not exist sufficient capacity in the sewage disposal system including collecting, pumping, treating, and disposing of wastes as may be discharged by the applicant of the new permit.
   (b)   Residential and Industrial Building Sewer Permits. There shall be two classes of building sewer permits, one for residential and commercial service, and one for service to establishments producing industrial wastes. In either case, the owner or his agent shall make application on a special form furnished by the Village. The permit application shall be supplemented by any plans, specifications, or other information considered pertinent in the judgment of the Village. A permit, inspection, and connection fee in the amount prescribed in the current rate schedule for a residential, commercial or industrial building shall be paid to the Village, through the office of the Village Administration at the time the application is filed, and the Village is to issue all permits hereunder.
   (c)   Owner Responsibility.
      (1)   All costs and expense incidental to the installation, connection and maintenance of the building sewer shall be borne by the owner. The owner shall indemnify the Village from any loss or damage that may directly or indirectly be occasioned by the installation and maintenance of the building sewer.
      (2)   In the event the Village ascertains that any property has been connected to the sewer system without a proper permit, the Village may disconnect such property until such violation ceases. In the event a property is disconnected and subsequently reconnected under this section, the owner shall be subject to the reconnection charges as provided for in the current rate schedule. Such charges shall be paid prior to reconnection being completed.
      (3)   When it is apparent a building sewer has failed and such apparent failure is located in the proximity of the connection to the public sewer, the owner shall cause said apparent failure to be excavated and appropriate repairs accomplished. If, upon excavation, the failure is beyond the building sewer connection, the Village shall make payment directly to the contractor, upon submittal of properly documented invoices, for work performed by the contractor at the direction of appropriate Village personnel.
      (4)   When a public sewer has been installed and paid for by a developer and the developer and the Village have entered into a Rotary Fee Agreement providing that the Village shall collect a fee specified in said Rotary Fee Agreement from property owners outside the developer's property who connect to said public sewer, the property owner desiring to make the connection shall pay the fee specified in said Rotary Agreement before connecting to said public sewer.
   (d)   All applications for permits for sewer taps must be made in writing to the Village Administrator by the owner of the real estate for whose benefit the application is made, or by his agent authorized in writing to make said application, and shall be accompanied by the fee specified in the Village Sewer and Tapping Permit Rate Schedule, to defray the cost of issuing such permit and the expenses of making the tap connection and/or supervising such connection. In addition, if a curb cut is required to install the requested utility service line an additional fee as specified in Village Water, Sewer and Tapping Permit Rate Schedule must accompany the application.
   (e)   The application shall state the location, number and description of the lot or lots to be served by said connection, the number of front feet, the name and address of the owner of said property, the number of buildings to be connected, the number of drains to be served by said connection and the number of water closets, sinks, tubs, showers, laundries and other water use facilities, or devices to be serviced by said tap or taps. The application shall state whether a curb cut is required for the installation of either the water or sewer tap or both. The application shall be made on the form prescribed by the Village Administrator.
   (f)   Building sewers shall be construed to mean the sewer running from the public sewer to the building drain.
   (g)   All building sewers shall be a minimum of six inches in diameter within the public right of way. Building sewers may be four inches in diameter on private property. Six inch diameter sewers shall have a minimum of 1% slope and a preferred slope of 2%. Four inch diameter building sewers shall have a minimum of 2% slope.
   (h)   In new subdivisions, all building sewers shall be constructed before the streets are surfaced. The maximum depth of the building sewer at the property line shall be ten feet.
   (i)   Risers with stoppers shall be installed on all sewers 12 feet in depth or more to a point ten feet below the street grade, in cases where a building sewer is not constructed to the property line.
   (j)   Where a building sewer is brought to the property line, a "Y" and/or a stopper shall be provided for each building site on all sewers under ten feet in depth.
   (k)   The building sewer or stub shall be marked by placing a two inch by two inch board vertically in the ground at the end of pipe extending four feet above finished grade.
   (l)   Footer, sump pump, any clear water line, or downspouts shall not be connected to any part of the sanitary sewer system.
   (m)   Each Building to Have Own Sewer: Exceptions. A separate and independent building sewer shall be provided for every building except where one building stands at the rear of another on an interior lot, and no private sewer is available or cannot be constructed to the rear building through an adjoining alley, court, or driveway, the building sewer from the front building may be extended to the rear building, and the whole considered as one building sewer.
   (n)   Old Building Sewers. Old building sewers may be used in connection with new building only when they are found on examination and test by an authorized representative of the Village to meet all requirements of this ordinance.
   (o)   Materials. The building sewer shall be (1) polyvinyl chloride (PVC) ASTM 3034 (SDR 35): or other suitable material approved by the Village. Joints shall be tight and waterproof. The Village may require the sewer installer to demonstrate the tightness of the joints by such tests as deemed necessary and require additional jointing material or concrete collars at any and all joints.
   (p)   Size and Slope: Clean Outs. Clean outs shall be installed on building sewers during initial construction and replacement of existing sewers. Clean outs shall be six inches in diameter and be installed no closer than three feet nor more than five feet from the outside wall of the structure. Clean outs shall be installed with a "T" branch installed at the flow lines and a water tight cap installed at or above finished grade.
   (q)   Depth: Grade: Direction. Whenever possible the building sewer shall be brought to the building at an elevation below the basement floor. No building sewer shall be laid parallel to or within three feet of any bearing wall, which might thereby be weakened. The depth shall be sufficient to afford protection from frost. The building sewer shall be laid at uniform grade and in straight alignment insofar as possible. Changes in direction shall be made only with proper fittings approved by the Village.
   (r)   Flow to Public Sewer. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by the drain shall be lifted by approved artificial means and discharged to the building sewer.
   (s)   Excavation: Pipe Laying: Backfill. All excavations required for the installations of a building sewer shall be open trench work, unless otherwise approved by the Village. Pipe laying and backfill shall be performed in accordance with ASTM specification C12 except that no backfill shall be placed until the work has been inspected.
   (t)   Joints and Connections.
      (1)   All joints and connections shall be made gastight and watertight. Cast-iron pipe joints shall be mechanical joint or push-on joint with O-ring gaskets.
      (2)   All joints in vitrified clay pipe shall conform to ASTM C-425.
      (3)   Joints and connections for PVC pipe shall conform to ASTM D-3212.
      (4)   Other joining materials and methods may be used only by approval of the Village.
   (u)   Procedure for Connection to Public Sewer. Connections into manholes shall be avoided, all connections must be made into the sewer proper; all tile used must be sanitary tile with approved sealed joints or made of materials approved by the Village Administrator. The connection of the building sewer into the public sewer shall be made at the Y-branch, if the branch is available at a suitable location. If no properly located Y-branch is available, the owner shall at his expense install a tap saddle or Inserta Tee in the public sewer at the location specified by the Village. The invert of the building sewer at the point of connection shall be at the same or at a higher elevation than the invert of the public sewer. A smooth neat joint shall be made, and the connection made secure and watertight by encasement in concrete. Special fittings may be used for the connection only when approved by the Village.
   (v)   Supervision of Connection. The applicant for the building sewer permit shall notify the Village, 24 hours prior to the building sewer being ready for inspection and connection to the public sewer. The connection shall be made under the supervision of the Village. The connection fee provided for in (b) above includes the cost of an inspection up to two (2) hours by the Village. Should more than two (2) hours of inspection be required because of failure of the owner, his contractor, or authorized representative to install, repair, alter, or perform other work necessary to install the connection and service line in accordance with these regulations, an additional fee as established by the Village shall be charged for the time required to comply with these regulations. Such additional fee shall be paid prior to the final approval of the service line for which the permit was issued.
   (w)   Protection of Public Restoration. All excavations for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways, and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Village.
   (x)   Distance Between Sewer and Other Pipe. No person shall lay any pipe or any conduit for any purpose whatsoever in any street within five feet on either side of a public sewer in any street without permission from the Village.
   (y)   Repairs of Surface. Any settlement of the surface over a drain on any street or public way occurring within six months after the laying of the drain shall be repaired by the Village at the expense of the drain layer if the repairs are not made by the drain layer within 24 hours after notice to repair is given to the drain layer by the Village.
   (z)   Drain Laying Work: Supervision and Permit. A licensed drain layer shall give his personal supervision to the drain laying work, and shall be present during the excavating for the same. The permit for the work issued by the Village must be kept on the line of work and shown to the Village Administrator or his/her authorized agent or to any officer or police officer upon demand.
   (aa)   Work with Public Sewer, License. No person shall uncover, make any connection with or opening into, alter, or disturb any public sewer or appurtenance thereof without first obtaining a permit and license from the Village.
   (bb)   License for Drain Layers. Persons working on connecting building plumbing with Village public sewer lines shall be licensed by the Village. Applicants for said license hereafter referred to as a 'drain layers', shall make application on a special form furnished by the Village. Applicants must prove to the satisfaction of the Village Administrator that they are familiar with the rules and regulations set forth in this Chapter, and that they possess the requisite knowledge and skill to install said building drain lines, and make said connections to the Village public sewer system. Applicants shall pay an annual fee for said license as set forth in a schedule of fees approved by Village Council.
   (cc)   Bond; Proof of Insurance; Workers' Compensation Coverage. Every person to whom a drain layer's license is granted shall be required to file a bond approved by the Village Administrator with at least two local sureties satisfactory to the Village Administrator, or with an approved surety company. Said surety bond shall be in the minimum sum of ten thousand dollars ($10,000) conditioned to indemnify and save harmless the Village from all damages arising from the laying of drains or the connection of building drains with the Village public sewer system. Applicants must also furnish proof of coverage under the Workers' Compensation laws of the State of Ohio, and also furnish proof of liability insurance in a minimum sum of five hundred thousand dollars ($500,000).
   (dd)   Revocation of License. Upon the failure of any licensed drain layer to comply fully with all the terms and requirements of this Ordinance, the Administrator may revoke his license for a period of six months or longer at the option of the Administrator.
