913.09 EXTENSION OF WATER SERVICES TO LAND CONTIGUOUS TO THE VILLAGE.
   (a)   If the lands to which water services are to be extended, service lines are to be enlarged, or additional service lines are to be extended, are contiguous to any land within the corporation limits of the Village, the Owner of said contiguous land must petition for annexation to the Village and continue to exert all efforts to obtain annexation until such annexation is complete before the property shall be eligible to receive water service. Village water services shall not be extended until the annexation has been granted or until the annexation has been denied by the County Commissioners.
   (b)   If the Owner’s petition for annexation is denied by the County Commissioners, the Owner, prior to receiving water services, enlarged lines, or additional service lines shall enter into a written agreement with the Village providing that the Owner will continue to exert all effort to obtain annexation of said contiguous property; agreeing further that should the Owner sell such property or any part thereof to be served by water service prior to annexation, that the Owner will require a similar agreement from any purchaser of land. The Owner further agrees to place a covenant in any deed conveying any part of said property originally contiguous to the Village of North Baltimore to which water services are extended, requiring that any purchaser consent to and exert all efforts to complete annexation of said property.
