909.05 VILLAGE MAY REMOVE.
   (a)   The Village Administrator shall have the right to prune, maintain, remove, or cause, or order to be removed, any tree, shrub, or part thereof that is in the public right-of-way or on public property, which by reason of its nature is injurious to existing sewers, electric power lines, gas lines, water lines, or other public improvements or that is a public safety hazard.
   (b)   The Village Administrator shall examine or cause to be examined every tree within 100 feet of any sanitary or storm sewer, drain, manhole, or other public utility line above or below the surface of the ground, which has been reported as dangerous to or as causing interference with said sewer, drain, manhole or public utility line. If found dangerous or causing damage or obstruction of such sewer, drain, manhole or public utility line, the Administrator shall cause the tree to be removed or trimmed if within the right-of-way or on public property, or give to the property owner written notice of his findings and an order that such person remove said tree or injurious part thereof within thirty (30) days if on private property. Service of such notice shall be as described in Section 909.04(c).
   (c)   If a tree on a public place is ordered removed pursuant to this Section, the stump shall be removed below the ground surface to facilitate landscaping.
