§ 156.048 DISCLOSURE AND REMEDIATION OF CONTAMINATION AND OTHER ADVERSE ENVIRONMENTAL CONDITIONS OF THE PROPERTY PRIOR TO APPROVAL OF SUBDIVISION AND DEVELOPMENT PLANS.
   (A)   Prior to any approval of any subdivision plan, the subdivider or developer shall be required to disclose and abate any and all adverse environmental conditions of the property.
   (B)   "Adverse environmental conditions" shall include, but shall not be limited to lead contamination, designation as a brownfield site by the EPA or DEQ, perpetual flooding, oil or petroleum contamination, derelict or unsafe buildings or structures, or any other condition which poses a danger to the flora or fauna of the property.
