§ 50.025 PURPOSE AND AUTHORITY.
   (A)   The purpose of this subchapter is to protect, maintain, and enhance public health, safety and general welfare by establishing a method of extending sanitary sewers into existing un-sewered neighborhoods within the Noblesville Wastewater Utility service area and outside the corporate boundary of the City.
   (B)   The City is responsible for planning sewer extensions, maintaining the collection system, and operating the wastewater treatment facility for the Wastewater Utility service area. The extension of sanitary sewers into existing neighborhoods within the Wastewater Utility service area will reduce health and environmental problems caused by failing septic systems.
   (C)   All sanitary sewer extensions must conform to City standards according to the Planning Commission requirements and the Unified Development Code and shall conform to the Wastewater Utility Standards for construction of sanitary sewers.
   (D)   I.C. 36-9-39 allows a municipality to construct sewers in an existing neighborhood and provides a payment mechanism to allow those benefited by the construction to pay for the improvements over a ten-year period. This statute is commonly referred to as the Barrett Law.
   (E)   The method of sanitary sewer extension set forth in this subchapter is intended to be a standard policy and guideline. Variances from these policies and guidelines may be considered by the Board of Public Works and Safety upon written application to the Board citing unusual conditions, justifying changes based upon sound engineering practices. Proposed variances shall have been reviewed by any applicable agency of jurisdiction, the Planning and Development Department, and/or the Technical Advisory Committee, as appropriate, before consideration by the Board of Public Works and Safety.
