(A) In a 14-day pay period when hours worked are greater than 80 but less than 86. A sworn officer that has worked more than 80 but less than 86 hours in a 14-day pay period may be compensated either with pay at the base hourly pay rate or with an equivalent amount of time off.
(B) In a 14-day period when hours worked are in excess of 86. A sworn officer that has worked more than 86 hours in a 14-day pay period shall be compensated at the base hourly pay rate for hours worked up to 86 hours. For the hours in excess of 86, the employee may elect to be paid either at the officer's overtime hourly pay rate or in an equivalent amount of compensatory time off as determined by the officer's annual compensatory time-off agreement.
(C) Computation of hours worked. For the purpose of calculating the number of hours worked in a pay period, paid benefit time off, which includes vacation leave, floating holiday, jury duty, bereavement, holiday hours, worker's compensation time and sick leave, shall not be deemed to be included as hours worked in that pay period. See FLSA § 207(e)(2).
