§ 36.28 RESTORATION TO JOB OR EQUIVALENT.
   An employee granted leave pursuant to this policy, upon return, shall be restored to the job he or she held when he or she left, or an equivalent position with equivalent pay, benefits and terms of employment. All benefits shall accrue during the leave. Upon reinstatement an employee who has allowed his/her health insurance coverage to lapse will be entitled to re-enroll. Certain key employees (as defined by the Family and Medical Leave Act) may be denied reinstatement if necessary to prevent substantial and grievous economic injury to the city.
