(A)   From and after the effective date stated hereafter, the city shall allow up to 12 weeks of leave in a rolling 12-month period measured backward from date leave began to an employee who requests the leave (except that any leave used prior to August 5, 1993 shall not be included):
      (1)   To care for a newborn child or a child who is newly placed for adoption or foster care;
      (2)   To care for a spouse, child, or parent who has a "serious health condition"; or
      (3)   Because the employee has a "serious" health condition that makes the employee unable to perform the functions of his/her job.
   (B)   The provisions of the policy shall not apply to any employee of the city who has been employed for less than 12 months or who has worked less than 1,250 hours during the preceding 12-month period.
