§ 90.36 RESTRICTION ON NUMBER OF CATS.
   (A)   No person shall keep or harbor more than three cats in any premises, dwelling, building, structure, boat or living accommodation unless:
      (1)   A female cat residing at the lot, premises, dwelling, building, structure, boat or living accommodation gives birth to a litter of kittens; provided, that all of the kittens shall be either sold or given to persons not living at the lot, premises, dwelling, building, structure, boat or living accommodation within 90 days after the kittens are born;
      (2)   Approved for a special permit under the provisions of § 90.37; or
      (3)   Previously granted a variance for the keeping of more than three cats from the Board of Zoning Appeals. The variance shall remain in effect until such time as the property is no longer in compliance with the conditions set forth in said variance.
   (B)   All cats shall be maintained within a premises, dwelling, building, structure, boat or living accommodation, and shall not be permitted to roam freely or trespass on another’s property.
   (C)   Any person keeping or harboring more than three cats in any premises, dwelling, building, structure, boat or living accommodation when this section was enacted shall not be in violation of this section; provided, that the person can affirmatively demonstrate through use of written witness statements from unrelated persons, veterinarian bills and other documentation that all of the cats were actually in residence on the premises, dwelling, building, structure, boat or living accommodation when this section was enacted.
