§ 90.34 RESTRICTION ON NUMBER OF DOGS.
   (A)   No person shall keep or harbor more than three dogs on any lot, premises, dwelling, building, structure, boat or living accommodation unless:
      (1)   Properly licensed as a commercial kennel or dog breeder in compliance with the zoning ordinance;
      (2)   A female dog residing at the lot, premises, dwelling, building, structure, boat or living accommodation gives birth to a litter of puppies; provided, that all of the puppies shall be either sold or given to persons not living at the lot, premises, dwelling, building, structure, boat or living accommodation within 90 days after the puppies are born;
      (3)   Approved for a special permit under the provisions of § 90.35; or
      (4)   Previously granted a variance for the keeping of more than three dogs from the Board of Zoning Appeals. The variance shall remain in effect until such time as the property is no longer in compliance with the conditions set forth in said variance.
   (B)   Any person keeping or harboring more than three dogs on any lot, premises, dwelling, building, structure, boat or living accommodation when this section is enacted shall not be in violation of this section; provided, that the person can affirmatively demonstrate through use of written witness statements from unrelated persons, veterinarian bills and other documentation that all of the dogs were actually in residence on the premises, dwelling, building, structure, boat or living accommodation when this section was amended.
