For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
OPERATOR. The person operating and having physical control over the motorized bicycle.
MOTORIZED BICYCLE. A bicycle with two or three wheels, a seat or saddle, fully operative pedals for human propulsion, and an electric or gas powered motor and which can propel the bike with or without pedal assistance (but this definition excludes two- or three-wheeled vehicles).
PROTECTIVE HELMET. A piece of headgear which meets or exceeds the impact standards for protective bicycle helmets set by the American National Standards Institute (ANSI) or the Snell Memorial Foundation’s standards for and materials (ASTM) for use in bicycling.
