(A) On and after August 1, 2015, there shall be an automatic lien on all real property for the municipal service fees imposed thereon under the authority of § 39.002, and for the delinquent fee imposed under the authority of § 39.003, and for other authorized charges imposed under this code, which lien shall attach on the first day of the month next succeeding the month for which the fee is imposed, and the fees imposed shall continue to accumulate until paid in full.
(B) Whenever the amount of any lien filed in accordance with this subchapter has been paid, together with costs, in full to the City Treasurer, the City Treasurer shall certify such payment to the Mayor, who shall execute and deliver to the party paying the lien a release of the lien, which may be recorded in the office of the County Clerk of the county wherein the property is located as other lien releases.
(C) The Mayor is authorized to issue a release of any such lien which may be filed by mistake against the wrong property, upon evidence of such mistake being presented to the Mayor by the City Treasurer.
(D) The city is authorized to foreclose on property that is delinquent in the payment of municipal service fees. The City Attorney shall develop the procedure for accomplishing this actions; provided, that in accordance with the authority granted by the Municipal Home Rule Board, the city shall not be required to prosecute the foreclosure in Circuit Court.
