§ 37.55 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   ALARM SYSTEM. Equipment installed in a structure and designed to signal:
      (1)   An illegal entry or other activity for which the Police Department is requested to respond; provided, that the alarm system activated may be either a silent or audible alarm, but does not include an automobile alarm; or
      (2)   The Putnam County 911, the Kanawha County 911 or the city’s Fire Department and that indicates a fire in the structure to which the city’s Fire Department is required to respond.
   ALARM USER. Any person, company or other entity whose business premises or residence within the city is protected by an alarm system within the city.
   FALSE ALARM. An alarm not resulting from an unauthorized entry, robbery or where no other crime was committed or attempted at the premises and includes a fire alarm when there is no fire. An alarm caused by power failure shall not be deemed a FALSE ALARM unless the power outage lasts longer than the alarm system’s battery backup. A FALSE ALARM does not include an alarm that activates during violent weather or an alarm the is activated maliciously.
   REPORTING PERIOD. Each 12-month period described in the first sentence of § 37.57.
