(A) The Mayor, in consultation with the Fire Chief, shall prepare and may from time to time amend rules and regulations not inconsistent with state law, the codified ordinances or other ordinance or resolution of Council, for the organization and government of the Fire Department and the personnel and property thereof. When such rules and regulations and any amendments thereof have been approved by ordinance or by resolution of Council and, having been so approved, have been placed on file in the office of the City Recorder and a true copy thereof having been placed on file at Fire Department headquarters for the information of all members of the Department, no member of the Fire Department shall violate or fail to comply with any such rule or regulation.
(B) Until such time as rules and regulations are promulgated and approved as provided in division (A) above, the rules and regulations of the Fire Department adopted by Council on February 6, 1968, which are on file in the office of the City Recorder, shall continue in full force and effect to the extent that they are not in conflict or incompatible with any provision of the codified ordinances; and the senior captain of the Fire Department as of the effective date of this code shall be ex officio Fire Chief.
