The City Council hereby finds the following:
(A) There exists a need for additional avenues to aid the Municipal Court in the collection of unpaid fines, fees and court costs, the total amount of which continues to increase;
(B) The State Legislature in response to the growing need for financial support, established a program, with the aid of the state’s Tax Department, to assist municipal courts to collect unpaid municipal fines, forfeitures, penalties, restitution, fees and court costs; and
(C) Therefore, the City Council does hereby establish and confer upon the city’s Municipal Court the authority to participate in the Municipal Court Income Tax Refund Offset Program established in accordance with W. Va. Code 8-10-2b, and all rules and procedures promulgated for its administration.
