(A) The Municipal Court Judge shall collect on behalf of the city such court costs, fees and/or fines as authorized by state law and these codified ordinances.
(B) In addition to any other fines, costs or fees that may be imposed, the following fines, costs and fees, as authorized and required by state law, shall be assessed and collected by the Municipal Court:
(1) Crime Victims Compensation Fund fee, as provided in W. Va. Code 14-2A-4, as amended, shall be:
(a) Eight dollars which shall be assessed on all misdemeanor pleas or convictions except violations of municipal parking ordinances or non-moving violations; plus
(b) Twenty percent of the assessed fine on each DUI conviction or plea.
(2) Law Enforcement Training Fund fee, as provided in W. Va. Code 30-29-4, as amended, shall be $2 which shall be assessed on all cases except violations of municipal parking ordinances;
(3) Regional Jail and Correctional Facility Development Fund fee, as provided in W. Va. Code 8-11-1, as amended, shall be $42 which shall be assessed on all moving traffic violations;
(4) DUI fine as provided in W. Va. Code 8-11-1b, as amended, shall be an amount not to exceed state law which shall be assessed on all DUI convictions;
(5) Municipal cost as authorized in W. Va. Code 8-11-1, as amended, shall be an amount not to exceed state law which shall be assessed on all cases; and
(6) Community Corrections Act fee, as provided in W. Va. Code 62-11C-4(d), as amended, shall be an amount not to exceed state law which shall be assessed on all criminal cases except violations of parking ordinances.
(C) When applicable, and in addition to any other fines, costs or fees that may be imposed, the following fines, costs and fees, as authorized and required by state law, shall be assessed and collected by the Municipal Court:
(1) Litter Control Fund fine, as provided in W. Va. Code 22-15A-4, as amended, shall consist of all of the following:
(a) A fine of an amount not to exceed state law;
(b) A civil penalty of an amount not to exceed state law;
(c) Two dollar Law Enforcement Training Fund fee;
(d) Eight dollar Crime Victims Compensations Fund fee; plus
(e) Ten dollar Community Corrections Fund fee.
(2) Home confinement fee, provided by W. Va. Code 62-11C-4(c), as amended, shall be a fee as set by Council from time to time, per day.
(D) For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
DUI. Driving under the influence as provided in W. Va. Code 17C-5-2 or 20-7-18b and § 70.055 of this code.
NON-MOVING VIOLATION. Invalid automobile registration; expired inspection sticker; invalid driver’s license; defective equipment; improper equipment; improper weight, height, length or width; and improper registration.
