§ 35.02 MUNICIPAL JUDGE.
   (A)   The Mayor shall be the Municipal Judge and, in the absence of the Mayor, the City Recorder shall exercise the functions of the Municipal Judge; provided, that the Mayor may at any time, pursuant to the provisions of W. Va. Code 8-10-2, appoint a member in good standing of the bar of Putnam or Kanawha County to the office of Municipal Judge or, in the exercise of sound discretion if a suitable member of the bar is not available for such office, may appoint a qualified person who is not a member of the bar to the office of the Municipal Judge.
   (B)   The Municipal Judge shall not receive any money belonging to the state or to individuals, unless he or she shall give the bond and security required of a magistrate, and all of the provisions of W. Va. Code Chapter 50, relating to money received by magistrates, shall apply to like money received by the Municipal Judge.
