§ 33.086 FEES.
   (A)   The fees for copies of requested records are as follows:
      (1)   The first five pages or fewer are provided at no charge on eight and one-half by 11 inches or eight and one-half by 14 inch paper;
      (2)   Each additional page is to be furnished at a charge of $0.50 per page printed on eight and one-half by 11 inches or eight and one-half by 14 inch paper; and
      (3)   Records reproduced on larger paper, tape recordings, videos or any other type of format other than the method described in division (A)(2) above, are provided at actual cost, of the larger paper, recording tape, video or other types of format other than the format described in division (A)(2) above.
   (B)   For records provided on disk furnished by the requester or by e-mail, there is no fee.
   (C)   For responses containing less than six pages of copies, there will be no fee assessed to the requester.
   (D)   The City Recorder shall have the discretion to determine if no fee shall be charged for a follow-up request because incorrect, inadequate or inaccurate information was provided in the response to the original FOIA request.
   (E)   Fees may be waived only by the City Recorder.
   (F)   The fee when received shall be forwarded to City Treasurer. All correspondence, including e-mail, and the response to the requester, shall be filed with and retained by the custodian. Additionally, the recorder shall, in accordance with W. Va. Code 29B-1-3a, provide all information as required by the office of the West Virginia Secretary of State.
   (G)   All fees charged for accident reports and photographs, whether on a disk or otherwise, shall be subject to the fee requirements imposed under the police service fee ordinance enacted March 17, 2009.
