§ 33.048 SALE OR LEASE OF PROPERTY HAVING A VALUE OF $10,000 OR MORE.
   In all cases involving a sale of city-owned real or personal property having a value of $10,000 or more, the city is authorized to sell any such property or any interest therein or any part thereof for a fair and adequate consideration; provided, that the property shall be sold at public auction at a place designated by the City Council; provided however, that before making any sale, notice of the time, terms and place of sale, together with a brief description of the property to be sold, shall be published as a Class II legal advertisement in compliance with the provisions of W. Va. Code 59-3-1 et seq. and the publication area shall include the city. The provisions of this section shall not be construed as being applicable to any transaction involving the trading in of municipally owned property on the purchase of new or other property for the city.
