Any course of dealing between or among any persons having any interest in or serving under the plan-trust cannot change or discharge any provision of the plan-trust declaration or any of the rights or obligations of any party. The failure of a party to exercise or assert any right under the plan-trust declaration shall not be deemed a waiver of any right under the plan-trust declaration.
