§ 35.043 SEPARABILITY.
   If a court finds that any provision of the plan is invalid, the plan shall be construed and enforced as if the invalid provision was not a provision of the plan unless the court finds or the Plan Administrator determines that such a construction of the plan would be clearly contrary to the intent of the plan or would be contrary to I.R.C. § 457(b) or would violate the enabling statute.
