139.01  AUXILIARY POLICE UNIT.
   (a)   There is hereby created an auxiliary police force, to be known as auxiliary policemen, members of the same to be appointed by the Mayor.  The auxiliary police unit shall not exceed ten members.
   (b)   Such auxiliary policemen shall serve so long as the Mayor may direct or until a resignation, submitted by such members, shall be accepted by the Mayor.

   (c)   Such members so appointed may not be under the age of twenty-one years at the time of their appointment.  (A.O.)
   (d)   The Chief of Police shall be the commanding officer of the auxiliary police force, subject to rules and regulations promulgated by the Mayor, and shall have control of the assignment, training, stationing and the powers, but shall perform only such police duties as assigned by the Chief of Police and shall act only when in the prescribed uniform or portion of uniform.  Said auxiliary members shall obey the chain of command of the division of the police and shall take orders from all regular appointed members thereof.
   (e)   The Mayor is hereby authorized to prescribe the type of uniform or part thereof which shall be worn.
   (f)   The Mayor shall prescribe the rules and regulations for the conduct and control of the auxiliary police force.  All services performed by said auxiliary policemen shall be on a voluntary basis and within the Village of New Washington.  Said auxiliary policemen shall serve without pay.
   (g)   This section is declared by Council as an exercise by the Village of its police powers for the protection of the public peace, health, property, safety and general welfare, and neither the Village, nor agent nor representative of such Village, nor any individual, firm, partnership, corporation, nor the receiver, nor trustees or any other agent thereof, who in good faith, executes any executive order, rule or regulations promulgated pursuant to the provisions of the sections above enumerated, shall be liable for injury or damages sustained to the person or property as a direct or proximate result of said action.
   (h)   The Mayor is hereby authorized and directed to promulgate rules and regulations as, in his discretion, are either necessary or desirable, in the administration of such auxiliary police force.
   (i)   The provisions of this section, individually or in total, shall not be construed as intended by this Council to be in conflict with any federal or state statute, or with any military or naval order, rule or regulation.
   (j)   The Mayor and the Clerk-Treasurer are hereby authorized and directed to enter into a contract with the Industrial Commission of Ohio to provide Workers’ Compensation coverage for said auxiliary policemen as provided by Ohio R.C. 4123.03, on such terms as are required by the Industrial Commission of Ohio.
