377.99 PENALTY.

Whoever violates any provision of Section 377.02 shall receive a warning; for a second offense committed within one year after the commission of the first offense, the person shall be guilty of a minor misdemeanor; for a third and/or subsequent offense committed within one year after the commission of the first offense, the person shall be guilty of a fourth degree misdemeanor.
