351.03 PROHIBITED STANDING OR PARKING PLACES.
   (a)    No person shall stand or park a vehicle, except when necessary to avoid conflict with other traffic or to comply with the provisions of this Traffic Code, or while obeying the directions of a police officer or a traffic control device, in any of the following places:
      (1)    On a sidewalk, including any area parallel to a public street or highway, designated as a sidewalk by yellow/orange/white parallel lines, cross-hatched, or a curb, street lawn area, except a bicycle;
      (2)    In front of a public or private driveway;
      (3)   Within an intersection;
      (4)   Within ten feet of a fire hydrant;
      (5)   On a crosswalk;
      (6)   Within twenty feet of a crosswalk at an intersection;
      (7)   Within thirty feet of, and upon the approach to, any flashing beacon, stop sign or traffic control device;
      (8)   Between a safety zone and the adjacent curb or within thirty feet of points on the curb immediately opposite the end of a safety zone, unless a different length is indicated by a traffic control device;
      (9)   Within fifty feet of the nearest rail of a railroad crossing;
      (10)   Within twenty feet of a driveway entrance to any fire station and, on the side of the street opposite the entrance to any fire station, within seventy-five feet of the entrance when it is properly posted with signs;
      (11)   Alongside or opposite any street excavation or obstruction when such standing or parking would obstruct traffic;
      (12)   Alongside any vehicle stopped or parked at the edge or curb of a street;
      (13)   Upon any bridge or other elevated structure upon a street, or within a street tunnel;
      (14)   At any place where signs prohibit stopping, standing or parking, or where the curbing or street is painted yellow, or at any place in excess of the maximum time limited by signs;
      (15)   Within one foot of another parked vehicle;
      (16)   On the roadway portion of a freeway, expressway or thruway. (ORC 4511.68)
      (17)   A.    A "devil strip", "street lawn area", "curb area", or "tree lawn area" is now referred to only as "devil strip". A "devil strip" is defined as the portion of streets, roads, and highways between the travelled and/or paved portion of such roadway extending to the furthest line of any existing sidewalk or within five feet from the edge of the travelled portion of the roadway where no sidewalk exists.
         B.    1.    It shall be unlawful for any person to stop or park a motor vehicle upon any devil strip, except in the case of emergency and or for those devil strips used for commercial purposes that have been improved with pavement, asphalt, or concrete materials for use as a parking area prior to the effective date of this subsection. Such areas can be used for parking as long as the property owner continues to properly maintain the areas for that purpose.
            2.   Parking on Quarry Street for those engaged in recreational activity at the Community Center and park shall be permitted.
            3.   It shall be unlawful to cut any existing curbs until written permission is granted by the City Manager. Applications to cut curbs shall be in writing with a fee of fifty dollars ($50.00) to cover the cost of inspecting the premises and issuing the permit.
            4.   It shall be unlawful to drive over the curbs or sidewalks except at a properly constructed driveway.
         C.    It shall be unlawful to park a motor vehicle on any devil strip parking area permitted by this subsection in such a manner as for any portion thereof to extend outside of the devil strip area into the travelled portion of the public highway upon which it may abut, or cross any sidewalk.
         D.   Once the devil strip is improved, the land owner will be totally responsible for repairs if the City must have access to their utility lines.
         E.   Reserved.
         F.   Reserved.
         G.   1.    On the southside of the Municipal Building, the first four parking spots starting from Canal Street in the lane closest to the building shall be reserved for the Fire Department personnel responding to fire calls. The remaining parking spots shall remain as general public use. A sign shall be posted showing that the reserved parking is restricted for Fire Department personnel responding to fire calls and the reserved parking shall be for twenty-four hours.
            2.   The Fire Department personnel, responding to fire calls, shall be permitted to park four additional cars between the lanes of parking currently in existence and the southside of the Municipal Building, known as the alley. Further, the Fire Department personnel responding to fire calls shall be permitted to parallel park in the devil strip on the southside of the Municipal Building, directly in front of the current two lane area used for public parking.
            3.   It is understood that any Fire Department personnel, responding to a fire call, parking their car in the devil strip or parking in the alley between the two lane area and the Municipal Building shall be moved as promptly as possible by the Fire Department. It is further understood that the four reserved parking areas shall be used first by the Fire Department before using the parking designated in the devil strip or alley designated parking.

         H.   Whoever violates any provision of this subsection shall receive a Twenty dollar ($20.00) fine if paid within three (3) business days, thereafter a Thirty Dollar fine ($30.00) if paid within thirty (30) business days. Further civil sanctions permitted under the Ohio Revised Code may be imposed by the Court for failure to pay any fine within thirty (30) days. Such person in guilty of a minor misdemeanor upon their third offense of this subsection within ninety (90) days. (Ord. 2017-15. Passed 9-5-17.)
         I.   1.    Previously allowed devil strip parking may be rescinded by the City Manager only upon a determination by the Chief of Police and the Nuisance/Zoning Inspector that said devil strip parking has created a traffic safety hazard.
            2.   The Chief of Police and the Nuisance/Zoning Inspector shall submit this determination in writing to the City Manager for his review. Before rescinding devil strip parking the City Manager shall forward to Planning and Zoning for a public hearing. Notification of the public hearing shall be sent by certified mail to the property owner affected by the rescission of devil strip parking and said public hearing shall be held within fifteen days of the notification to the property owner. The affected property owner shall have the opportunity to present evidence on his/her/its behalf at the public hearing.
            3.   Final decision to rescind devil strip parking shall be determined by the Planning and Zoning Commission within fifteen days after the public hearing. The City Manager shall notify the affected property owner by mail of his decision to rescind or allow devil strip parking. Said decision will go into effect at the earliest time allowable by law.
