1105.06 MAJOR SUBDIVISION.
   (a)   Discussion of Requirements. Before preparing the site plan or submitting an application for approval to subdivide, the applicant should discuss with the City Manager or designate, the procedure for adoption of the subdivision plat and requirements as to the general requirements, the availability of existing services, and standards for the design of public improvements.
   (b)   Application. Prior to subdividing land, the owner or owners agent shall file an application for approval to subdivide. The request shall be made on forms available at the Clerk's office. It shall be accompanied by a minimum of nine copies of the site plan as described in these Regulations, and complying in all respects with these Regulations. The application shall include all contiguous holdings of the owner including land in the "same ownership" as defined herein, with an indication of the portion which is proposed to be subdivided, accompanied by an affidavit of ownership, which shall include the dates the respective holdings of the land were acquired, together with the book and page of each conveyance to the present owner as recorded in the County Recorder of Deeds office. The affidavit shall advise as to the legal owner of the property, a contract owner of the property, the date the contact of sale was executed, and, if any corporations are involved, a complete list of all directors, officers, and stock holders or each corporation owning more than five percent (5%) of any class of stock. The application shall be accompanied by all required fees set by the City. The application shall include address and telephone number of an agent authorized to receive all notices required by these Regulations.
   (c)   Site Plan. A site plan shall be legibly drawn at a scale not to exceed one inch equals 100 feet and contain the following information:
      (1)   A legal description of the proposed subdivision.
      (2)   The scale, name of the proposed subdivision, north arrow, and the date.
      (3)   Location of property lines.
      (4)   Existing easements and rights-of-way.
      (5)   Existing water courses.
      (6)   Existing wooded area.
      (7)   Location, width, and names of all existing or platted streets or other public ways within or immediately adjacent to the tract to be subdivided.
      (8)   Names of adjoining property owners from the latest County assessment rolls.
      (9)   Location, sizes, elevations and slopes of existing sewers, water mains, culverts, and other underground structures within the tract or immediately adjacent thereto.
      (10)   Location of existing permanent buildings.
      (11)   Approximate existing topography, at a minimum of two foot intervals.
      (12)   Location and widths of proposed streets.
      (13)   Preliminary proposals for connection with existing water supply and sanitary sewerage systems, preliminary provisions for collecting and discharging surface water drainage.
      (14)   The approximate location, dimensions and areas of all proposed or existing lots.
      (15)   The approximate location, dimensions, and areas of all parcels of land proposed to be set aside for park or playground use or other public use for the use of property owners in the proposed subdivision.
      (16)   The location of temporary stakes to enable the Planning Commission to find and appraise features of the sketch plat in the field.
      (17)   Whenever the site plan covers only a part of the applicant's contiguous holdings, the applicant shall submit, at a scale of no more than two hundred feet to the inch, a plan in pin of the entire holding, together with its proposed street systems, an indication of the probable future streets, a comprehensive sanitary sewer plan, and a plan of the proposed drainage system for the remaining portion of the tract.
      (18)   Property owner's name.
      (19)   List of covenants, liens and encumbrances.
      (20)   Conveyance (Book and Page) to owner.
      (21)   Names and addresses of engineer(s) and surveyor preparing site plan.
      (22)   Location map.
   (d)   Concept Review. Upon compliance with the above sections, the Clerk shall arrange and confirm in writing a suitable time for concept review with the subdivider and appropriate staff members. The concept review shall take place not more than fifteen working days after receipt of such application by the Clerk. After submitting the site plan, but prior to preparing the preliminary plat, the owner shall discuss with appropriate City staff the requirements as to the general lay out of streets and for reservations of land, street improvements, drainage, sewage, fire protection and similar matters. The concept review shall be an informal review of land use and development concepts, pertinent regulations and required public improvements. Specific discussions shall revolve around all aspects of the submitted plan. The City Manager shall discuss possible reservations with the proposed site plan and indicate areas of the proposal which could be improved.
   (e)   Commission Site Plan Review. Following concept review, the Clerk shall include on the agenda for the next regularly scheduled Planning Commission meeting, an informal discussion of the proposed site plan. The owner or owners agent stated on the application, shall be notified in writing of the location, time and date of the meeting by the Clerk. Such person may be present at the meeting to make a presentation or answer any questions the Commission or staff may have. After such discussions, the Commission may schedule a field trip to the site of the proposed subdivision accompanied by the applicant. In order to facilitate the field inspection and review of the site of the proposed subdivision, temporary staking along the center line of all proposed roads in the subdivision will be required in time for such field trip, or if impractical, the Commission shall permit a suitable alternative procedure. After reviewing and discussing the site plan, the Commission will advise the applicant of any and all specific changes or additions it will require in the layout and the character and extent of required improvements and regulations which it will require as a prerequisite to the approval of the subdivision plat. The Commission may, require additional changes as a result of further study of the subdivision in a final form. Such approval shall constitute authorization to prepare and submit the preliminary plat. Approval or disapproval of the site plan shall be made by the Commission within thirty days after initial presentation to the Commission.
