(a) Any vacancy in the office of Councilman may be filled within 45 days of the creation of the vacancy by a majority vote of the remaining Councilmen. Upon failure to make such appointment for the vacant office of Councilman within 45 days, the Mayor must make such appointment within 15 days of the expiration of the 45 day period within which Council has the authority to make the appointment. A qualified elector as defined in Article III; Section 2 of the affected ward within the City shall fill vacancies of the office of Councilman. The individual filling the vacancy shall be appointed only until a general election can be held for the office. Should an incoming member die, resign, or be disqualified between the election and the time of taking office, the position shall be vacant until filled under the provisions of this section.
(b) Upon the existence of a vacancy in the office of Councilman, the Clerk of Council shall advertise for interested qualified candidates to fill the vacant Council position and provide Council with a list of the interested eligible candidates who applied. Council may only select candidates from the list provided by the Clerk of Council. If the appointment is made by the Mayor, the Mayor is not restricted to appointing a candidate from the list provided to Council by the Clerk.
