§ 31.014 RESIDENCY REQUIREMENTS.
   (A)   (1)   The City Administrator shall reside within the city limits. In the event that the City Attorney becomes a city employee they too shall reside within the city limits.
      (2)   The Police Chief, Fire Chief, Public Works Director, Economic Development Director, Director of Planning and Zoning, City Clerk and Library Director shall reside within the Newton School District limits. In the event that titles change for the Directors, or new Director positions are created, they too shall reside within the Newton School District limits.
   (B)   (1)   City employees within the positions identified in division (A) above who are not in compliance with the residency requirement may continue to be exempt from the residency requirement as long as they remain a full-time employee. However, if the incumbent vacates the position, residency will be required as outlined in division (A) above.
      (2)   Retirement exception: an employee may make application to the City Administrator for a waiver of the residency requirement if the employee has submitted to the City Administrator a notice of retirement with an effective date of not greater than 18 months away. The waiver is intended to allow for a smoother transition to private life after public service to the city. The City Administrator, in reviewing the request for a waiver, shall consider the following factors in determining whether to grant a waiver: how far away will the employee move to; how much time will this situation exist; and how will issues involving availability and accessibility be minimized.
   (C)   (1)   Residency requirements are effective no later than seven months after start date of city employment.
      (2)   Should an employee subject to the residency requirement become in non-compliance with the residency requirement, the employee shall be deemed to have voluntarily resigned from city employment.
   (D)   Newton Water Works personnel are exempt from the provisions of this section.
   (E)   (1)   RESIDENCE is the actual domicile of the employee where that employee normally eats and sleeps and maintains the normal personal and household effects necessary for day-to-day living.
      (2)   RESIDENCE shall not include a place secured solely for the purpose of meeting this requirement which is maintained in addition to the employee’s actual place of residence outside of his or her residency requirement area.
