The purpose of this chapter is to specify requirements for the establishment, construction, operation and maintenance of a cable system in the city pursuant to Iowa Code Ch. 364 and applicable federal law. If a new applicant submits a proposal acceptable to the then grantor, meets the requirements of this chapter and those of the FCC and applicable state law, the grantor may then proceed to enter into a non-exclusive franchise agreement with the city pursuant to the requirements of this chapter. If the incumbent operator submits a proposal acceptable under the terms of the Cable Act as amended, being 47 USC 521 et seq., and meets the requirements of the FCC, the city shall proceed to fulfill its obligations under § 626 of the Telecommunications Act of 1996.
